1. Introduction

Welcome to Ghosted Fix ("we," "our," or "us"), a service operated by New Horizon Labs, LLC. These Terms of Service ("Terms") govern your access to and use of the Ghosted Fix website, applications, and services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

  • "User," "You," and "Your" refer to individuals who access or use the Service.
  • "Content" refers to all text, information, images, audio, video, or other material that you submit to the Service, including but not limited to conversation data, profile information, and dating app conversations.
  • "AI Analysis" refers to the automated analysis performed on your Content by our artificial intelligence systems.

3. Account Registration and Eligibility

3.1 Account Creation

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

3.3 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment Terms

4.1 Subscription Plans

We offer both free and premium subscription plans. The free plan provides limited access to the Service features, while premium plans offer additional features and capabilities.

4.2 Pricing and Payment

Premium subscription prices are displayed within the Service. We currently offer monthly ($7.99 USD) and yearly ($59.99 USD) subscription options. All payments are processed through Stripe, our third-party payment processor.

4.3 Subscription Renewal

Your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date.

4.4 Cancellation Policy

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period, after which your account will revert to the free tier.

4.5 Refunds

We do not provide refunds for unused portions of subscription periods.

5. User Content and Conduct

5.1 Content Ownership

You retain all rights to the Content you submit to the Service. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such Content for the purpose of providing and improving the Service.

5.2 Content Restrictions

You agree not to submit Content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Contains sexually explicit material or promotes violence
  • Infringes upon the intellectual property rights of others
  • Contains malware, viruses, or other harmful computer code
  • Violates the privacy rights of individuals by sharing excessive personal or identifying information about people not directly involved in your dating interactions

5.3 Content Analysis

Our Service includes features for analyzing user-submitted content to help improve dating communication. When submitting content to our Service:

  • You represent that you have the right to share such content with us
  • You may include basic information necessary for the service to function
  • You should exercise appropriate discretion when sharing information about others
  • We reserve the right to reject or remove any content that we determine to be inappropriate
  • You acknowledge that the purpose of sharing content is for analysis and improvement of your dating experience

5.4 Content Moderation

We use automated and manual systems to moderate Content. We reserve the right to:

  • Remove any Content that violates these Terms without prior notice
  • Reject uploads that contain unnecessary personal information about third parties
  • Suspend accounts that repeatedly violate our content guidelines
  • Process removal requests from individuals about their personal information

6. AI Analysis and Data Usage

6.1 AI Analysis Features

The Service uses artificial intelligence to analyze your Content to provide feedback, suggestions, and analysis. Our AI analysis focuses on communication patterns, response effectiveness, and improvement strategies. We do not attempt to identify or track individuals mentioned in your Content.

6.2 Legitimate Interest

Our processing of user content is based on legitimate interests to:

  • Help users understand and improve their communication patterns
  • Provide data-driven insights about effective relationship strategies
  • Analyze patterns in interactions to offer better advice
  • Enhance the quality and relevance of our service

We balance these interests with privacy protection through strict content moderation and data security measures.

6.3 Third-Party AI Services

We use OpenAI's services to power certain features of the Service. Your use of the Service is also subject to OpenAI's terms of service and privacy policy. We are not responsible for any data handling or breaches by third-party providers; please review their policies for details on their practices.

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Ghosted Fix.

7.2 Feedback

If you provide us with feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.

8. Privacy

Your privacy is important to us. Our Privacy Policy, available at ghostedfix.com/policies/privacy, describes how we collect, use, and share information about you when you use the Service. By using the Service, you agree to the terms of our Privacy Policy.

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GHOSTED FIX, ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any other matter relating to the Service

9.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

11. Indemnification

You agree to defend, indemnify, and hold harmless Ghosted Fix, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Disclaimer

12.1 Not Professional Advice

Ghosted Fix ("we," "our," or "us") provides an AI-powered dating insights platform. The information and suggestions provided through our Service are for general informational purposes only and do not constitute professional psychological, therapeutic, or counseling services.

12.2 No Licensed Professionals

We are not licensed therapists, psychologists, psychiatrists, or mental health professionals. Our AI-powered analyses and suggestions should not be considered a substitute for professional advice, diagnosis, or treatment from qualified mental health professionals or relationship counselors.

12.3 No Guarantees

We make no guarantees regarding the accuracy, effectiveness, or outcomes of using our Service. Results may vary based on individual circumstances, and success in dating relationships depends on numerous factors beyond our control.

12.4 Not For Crisis Situations

Our Service is not designed to address crisis situations or severe mental health issues. If you are experiencing emotional distress, thoughts of harming yourself or others, or require immediate assistance, please contact a mental health professional, call your local emergency services (911 in the US), or text/call the 988 Suicide & Crisis Lifeline.

12.5 User Responsibility

By using our Service, you acknowledge and agree that you are solely responsible for your actions and decisions based on the information provided through our Service. You should exercise your own judgment and, when appropriate, consult with qualified professionals regarding specific personal situations.

13. Termination

13.1 Termination by You

You may terminate your account at any time by following the instructions on the Service or by contacting us.

13.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach the Terms.

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. If your account is terminated due to a breach of these Terms, you may not register for a new account without our permission.

14. Governing Law

These Terms shall be governed by the laws of the United States, without regard to its conflict of law provisions.

15. Changes to Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes your acceptance.

20. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent.

21. Dispute Resolution and Arbitration

21.1 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

21.2 Class Action Waiver

Any proceedings to resolve disputes shall be conducted on an individual basis. Neither you nor we shall join or consolidate claims with those of any other party or participate in any class, collective, or representative proceeding.

22. Survival

The sections regarding Intellectual Property, Limitation of Liability, Disclaimer of Warranties, Indemnification, and Dispute Resolution shall survive the termination of these Terms.
